So we know that there is no way beforehand to identify forced subtitles, or subtitle streams that would be forced in the movie but aren't flagged forced. Here's a simple solution I've been using for a couple of years now and it has only failed me once.
A simple check box to search for forced subtitles. An input box with a caption similar to "Assume a subtitle is forced if number of captions is % lower than the highest caption count". You demux all subtitles, keeping track of the number of captions and forced (if any). Should no forced subtitles be found, include any subtitle streams that are the percentage or lower of the maximum number of captions found.
Like I said, this has only failed me once. It found the directors comments subtitles that just showed who was talking at that time if you were listening to the directors comments audio track.
