ist AndyDVD HD illegal in Deutschland?
soweit ich weiß ist nur das bewerben dieser Software in DE eventuell illegal (siehe Heise).

Der Gebrauch ist strafbar, sowie der Verkauf, allerdings wohl nicht der Kauf?

Man kann den Erwerb dieser Software ja als "Spende" sehen ;-).
 
Da wir alle hier nur die geutsche Sprache nutzen, jedoch irgendwo auf der Welt leben, wo es statt legal oder Illegal nur Scheißegal gibt, ist diese Frage nicht von Relevanz. ;)

Please. Read your law. If I translate correctly, "strafbar" is a crime, and no, it is not.
See §108b (1) German copyright law. Read it. Again and again. Using AnyDVD for your own personal use will *not be punished*.

In Österreich hingegen ist jegliche Umgehung einer technischen Schutzmaßnahme strafbar, selbst wenn die Kopie für den privaten Gebrauch gedacht wäre (§ 90b und § 90c österreichisches Urheberrechtsgesetz). In diesem Fall kann sowohl zivil- als auch strafrechtlich gegen den Übeltäter vorgegangen werden.

I can't see any mention of a punishable act in § 90c auf the Austrian law. But I haven't translated the whole text, this is probably specified in a different §. Anyway, as the thread title indicates, this was about German law.

Sounds to me, that own personal use is explicitly excluded from beeing punishable. So, the Austrian law seems to be very similar to the German law.

I read the crucial sentence you quoted serveral times again and again and now I've got the feeling that you are right and the legislation in Austria is the same like in Germany.
When I have time, I will look up how this sentence you quoted must be interpreted from a legal point of view (just to be on the safe side).

could be a loophole, as the "other person" could be... well, any other person. ;)
The Germans restrict this exception to "another person, you have a personal relationship" with. Not some "Internet contact":
...wenn die Tat nicht ausschließlich zum eigenen privaten Gebrauch des Täters oder mit dem Täter persönlich verbundener Personen erfolgt oder sich auf einen derartigen Gebrauch bezieht...

Nicht vergessen an jeder "Straßenecke" groß Werbung machen damit man auch "Sanktionen" erhält. Wenn man sich über solche Dinge hier Gedanken macht sollte man solche Software nicht einsetzen. Ich für meinen Teil bewege mich mit anderer Software genau auf der Linie zwischen Recht und Unrecht.

Sobald man Software an eine andere Systemumgebung ohne Zustimmung umbaut begeht man einen Rechtsbruch unabhängig davon ob man es Dritten zugänglich macht.
 
Wenn man sich über solche Dinge hier Gedanken macht sollte man solche Software nicht einsetzen
